In rejecting developers’ arguments to overturn the town’s use of eminent domain, the court declared as unconstitutional a law passed in 2004 that made it illegal for cities and towns to condemn land for open space, park or recreational purposes.

A jury last year set the price of the land at $50 million, the amount appraised by the private property owners.
